There are so many disputes that it’s conscripting private arbitrators, many without law degrees, to churn out the decisions. And they can't keep up. The arbitrators handling these cases must apply a five-step “balancing test” so vague it’s nearly impossible to use — and, by law, they can’t rely on precedent to ensure consistency. In our new paper, “Bonfire of the Vagaries: Toward a Less Imperfect Arbitrator Under Texas Medical Association v. HHS”, we explore why this design failure has paralyzed payment resolution — and how an AI-supported arbitration framework could finally bring speed, clarity, and fairness to the process.
