The Danebritt Group Pty Ltd has been convicted and fined $90,000 in the Industrial Court of NSW as a result of a prosecution by SafeWork NSW. The proceedings arose from an incident on 24 November 2022, when two workers were placed at risk while stocking a newly installed sunglasses display cabinet that was only partially affixed to a wall. The Danebritt Group Pty Ltd plead guilty to an offence pursuant to section 33 of the Work Health and Safety Act 2011 (NSW) for failing to comply with its health and safety duty to persons other than workers under section 19(2) of the Act. JBS Australia Pty Ltd has been convicted and fined $330,000 in the District Court of NSW as a result of a prosecution by SafeWork NSW. The proceedings arose following a workplace incident on 14 July 2022, when a worker was injured after being struck by a forklift in a chilled storage area for processed meat. The worker suffered severe injuries to his left leg as a result of the collision. JBS Australia plead guilty to an offence pursuant to section 32 of the Work Health and Safety Act 2011 (NSW) for failing to comply with its health and safety duty to workers under section 19(1) of the Act. On 2 July 2022 a worker’s hand was drawn into and became caught between two metal rollers of a cardboard sheeter machine. The worker suffered serious hand injuries. Westrock Oceania Pty Ltd (Westrock) were charged under sections 19(1) and 32 of the Work Health and Safety Act 2011. Westrock approached SafeWork NSW about entering into an enforceable undertaking as an alternative to the Court proceedings. On 17 October 2025 SafeWork NSW accepted an enforceable undertaking from Westrock. Under the terms of the enforceable undertaking Westrock will: Design and implement robotic automation of the Flat Work area to reduce the interaction between people and mobile plant items and reduce manual handling injuries Engage a third-party auditor to conduct an audit in relation to sheeter machine safety Share lessons learnt from the incident and safety successes in relation to the Flat Work automation project with industry through a case study. SafeWork NSW will monitor Westrock to ensure the terms of the enforceable undertaking are delivered. From 1 January 2026, workplaces where employees are exposed to hazardous noise must provide audiometric testing (hearing checks). This is a legal requirement under Clause 58 of the Work Health and Safety Regulation 2025. What does this mean for workplaces? - You need to identify roles and tasks where workers are exposed to hazardous noise. - Implement a process for audiometric testing within 3 months of a worker starting and every 2 years after that. - Review your risk management strategies for noise exposure and ensure hearing protection programs are in place. Non-compliance can lead to enforcement action, but more importantly, hearing loss is irreversible. Early testing helps protect your workforce and demonstrates your commitment to safety. 2 Types Constructions Pty Ltd has been convicted and fined $270,000 in the District Court of NSW as a result of a prosecution by SafeWork NSW. The proceedings arose following a workplace incident on 19 April 2022, when a worker fell about four metres through an unprotected skylight onto a concrete floor at a building refurbishment project in Kingsgrove in Sydney’s south.
